Please read this agreement carefully before starting your registration on the www.myphotostory.com.ua

My Photo Stories online service, hereinafter referred to as the "Producer", offers any natural or legal person, hereinafter referred to as the "Customer", place an order on the website www.myphotostory.com.uafor the individual production of photo products from self-prepared original layouts.

Creating your personal profile (hereinafter Registration) and placing an order confirms the Customer's agreement with all terms of this agreement, and obligates the Customer to comply with these terms or to stop using them site.

1. GENERAL PROVISIONS

• 1.1. This contract is a public offer and does not require signature (in accordance with Articles 633, 641 and Chapter 63 of the Civil Code of Ukraine). The public offer agreement has the same legal force as a contract signed on paper This contract contains all essential conditions for the organization of purchase and sale remotely, i.e. according to using the Internet, which excludes the possibility of direct acquaintance of the Buyer with the Product.
• 1.2. In case of acceptance of the terms of this contract (i.e. a public offer of an Internet service), a citizen (or legal entity) accepting the offer becomes the Customer. Acceptance is the fact of payment of the order in the amount 100% under the terms of this agreement.
• 1.3. The manufacturer produces photo products according to the created layout in the site designer. The customer through the Internet service www.myphotostory.com.ua
• 1.4. Within the framework of this Agreement, the design (image of the corresponding product) is usually recognized as a product sample a certain product group with a description of its properties, materials and additional options) of the product line.
• 1.5. The manufacturer reserves the right to make changes to this Agreement without prior notice.

2. RIGHTS AND OBLIGATIONS OF THE CUSTOMER

• 2.1. To place an order, the Customer undergoes automatic registration on the Site.
• 2.2. The customer orders goods by independently creating layouts in the designer on the website, which are created in accordance with the technical requirements on the Site and sends it to the Manufacturer.
• 2.3. If the Customer has any questions regarding the properties and characteristics of the final products, before placing the order, the Customer can ask the Manufacturer for clarification in any available way.
• 2.4. The customer undertakes to correctly indicate his surname, first name, contact phone number in the order, including city code, exact and complete shipping address, and shipping method.
• 2.5. The customer has the right to refuse the manufactured order if it is present in the photo product technological defect or options and ordered parameters do not correspond to the order placed on the website and are subject to the return conditions described in clause 6 of this agreement. When canceling an order, the Customer must provide the Manufacturer with a high-quality photo and video of the defective photo product fragments with a description of the problem by e-mail and, if the claim is satisfied, return the defective order to the Manufacturer. Payment of transport costs in case of return is made at the expense of the Manufacturer.
• 2.6. The customer pays for the order in any way chosen in the online service within two working days from date of registration in the amount of 100% advance payment.

3. RIGHTS AND OBLIGATIONS OF THE MANUFACTURER

• 3.1. The manufacturer informs the Customer about the acceptance of the order by e-mail, and if necessary, agrees on the additional characteristics, the completeness of the order and its cost.
• 3.2. The manufacturer undertakes to produce the order in accordance with the received parameters, quantity, and prices and terms.
• 3.3. The manufacturer guarantees compliance of the appearance of the ordered products with those described in the relevant sections of the site. The characteristics and appearance of the product declared on the Site may slightly differ from description that is related to differences in the display of images on the Customer's monitor.
• 3.4. The manufacturer is not responsible for the accuracy and correctness of the information provided by the Customer registration

4. DELIVERY

• 4.1. Delivery of goods is carried out throughout the territory of Ukraine, as well as abroad.
• 4.2. The manufacturer will make every effort to comply with the delivery terms agreed with the Customer. However, delays in delivery are possible due to unforeseen circumstances that did not occur through the fault of the Manufacturer.
• 4.3. The cost of delivery of orders on the territory of Ukraine and abroad is paid by the Customer according to the tariffs courier companies.
• 4.4. When receiving an order by mail or from a courier, the Customer must check the package in person delivery service employee. If, after unpacking, a shortage, replacement or damage of the product is found, then The Customer must draw up an Act and report the problem to the Manufacturer in any available way. In another case, the Manufacturer is not responsible for possible damage or theft of the parcel.

5. COST OF GOODS

• 5.1. The exact price of the goods is specified in the Prices section on the website www.myphotostory.com.ua
• 5.2. The price of the product on the Site can be changed by the Manufacturer unilaterally without additional notice The customer.

6. RETURN TERMS

• 6.1. In its activities, the Manufacturer is guided by Addendum N3 to the resolution of the Cabinet of Ministers of Ukraine dated 19 March 1994 No. 172 "On the Implementation of Certain Provisions of the Law of Ukraine" "On the Protection of Consumer Rights", according to by which printed products belong to the list of products that cannot be exchanged (returned).
• 6.2. The manufacturer guarantees the proper quality of photo production, which meets the standards adopted for digital and photo printing and bookbinding works. As in any other industrial printing process, they can there may be minor defects in print quality that do not distort the overall perception of the image. For the majority for most orders, this level of image defects is acceptable, and the quality of photo production is considered acceptable.
• 6.3. The manufacturer does not carry out color correction (or any other) of the original layouts of the Customers and prints images in the form in which they were uploaded by the Customer, therefore, the original layouts provided by the user must strictly meet the technical requirements.
• 6.4. The manufacturer does not accept quality claims related to: violation of technical requirements for original layouts, inhomogeneity of large areas of solid image fills, the presence of weak on individual images noticeable points, spots, stripes or other minor defects located in the plot-secondary part original layout.

7. PHOTOGRAPHS OF THE CUSTOMER

• 7.1. In accordance with the agreement, posting and uploading to the site or receiving through the Site is not allowed original layouts created by the Customer containing elements of pornography, violence, those that affect sense of honor and dignity of other citizens; as well as any other materials that may lead to civil or criminal liability in accordance with the current legislation of Ukraine.
• 7.2. It is forbidden to place orders that violate the rights to privacy, publicity, copyright or related rights without permission of the image owners.
• 7.3. In the case of ordering the printing of images that are censored for viewing by persons over the age of 18, or contain words of obscene language, the Manufacturer is not responsible for the content of such a service.
• 7.4. The customer independently and at his own expense undertakes to settle all claims of third parties, related to the creation of images printed by the Manufacturer if they violate the above items.

8. COPYRIGHT ON SITE MATERIALS AND SOFTWARE

• 8.1. All information, content, software and other materials posted on the Site are protected by law on the protection of copyright and related rights. In accordance with the current legislation of Ukraine, copying is prohibited and distribution of these materials without the written consent of the Manufacturer.
• 8.2. The manufacturer may conduct a periodic mailing with information about its services to the registered e-mail address of the Customer. The customer can opt out of the mailing in the settings of his profile or through electronic form embedded in the letter.

9. OTHER TERMS

• 9.1. The Customer gives permission for the Manufacturer to process his personal data for the purpose of fulfilling the conditions of this Agreement, the possibility of mutual settlements, as well as for receiving invoices, acts and others documents
• 9.2. All information provided by the Customer to the Manufacturer, which cannot be transferred for review and / or use by third parties, with the exception of the written permission of the Customer for the transfer of this information and conditions, when required by Ukrainian or international legislation and/or authorities in compliance with the law procedures
• 9.3. The law of Ukraine applies to the relations between the Customer and the Contractor.
• 9.4. In case of questions and claims from the Customer, he should contact the Manufacturer at any time available method. The parties will try to resolve all disputes that may arise through negotiations. If it is impossible to reach an agreement, the dispute will be referred to a judicial authority in accordance with the applicable law legislation of Ukraine.
• 9.5. Content, materials and software posted on the Site are provided to the Customer "as is", without of any warranties, express or implied.
• 9.6. The manufacturer does everything possible for the uninterrupted functioning of the Site and the provision of services, but does not guarantee continuous, timely and error-free operation of the site, programs, other services, Internet connection, web browser and registered accounts of the Customer.
• 9.7. The Customer undertakes to regularly monitor all changes to the Agreement posted on the Manufacturer's website.

10. DURATION OF THIS AGREEMENT

• 10.1. This contract enters into force from the date of payment of the order and is valid until all conditions are fulfilled.
